Duty of Candour Consultation

Eluned Morgan, Minster for Health and Social Services has issued a Written Statement to launch this consultation that can be found here.

The Duty of Candour introduces a new step in improving openness and honesty in how people are informed if they suffer harm in the NHS.  When this happens, it is vital people are provided with an apology, told honestly about what happened and that action will be taken to find out why. It is a very positive step forward in improving health services for the people of Wales focusing on learning and improvement rather than any element of blame.

The consultation asks for responses on 4 documents and we welcome responses from all parts of the health and care sector and Welsh communities. Please promote this consultation with your networks. The 4 core documents contained in the consultation are:

1.    The Duty of Candour Procedure Regulations

2.    The Duty of Candour Statutory Guidance

The above are new documents but the Duty of Candour will also have some implications for the Putting things Right process which are set out in:

3.    The Amendments to Putting Things Right Regulations

4.    The Amendments to Putting Things Right guidance

We recognise the length of time the Putting Things Right process has been in place and consequently people may wish to make a significant comment on these documents.   We ask that for the purposes of this consultation, responses are related to the introduction of the Duty of Candour as far as possible. A full review of the Putting Things Right process has been committed to by the Minister for Health and Social Services in the future.

This link to the consultation also contains several other resources such as easy read versions and an awareness video to help people from all parts of the community to feel comfortable responding.

The Candour Consultation will run from the 20th September to the 13th December 2022 and details on how to submit responses are in the consultation documents.
