Government Consultation on Sexual Harassment in the Workplace

Ymgynghoriad Llywodraeth ar Aflonyddu Rhywiol yn y Gweithle

Ar 15 Gorffennaf  lansiodd Swyddfa Cydraddoldeb y Llywodraeth ymgynghoriad ar aflonyddu rhywiol yn y gweithle. Maent yn ymgynghori ar y ddyletswydd orfodol, yn egluro’r gyfraith ar aflonyddu trydydd parti, p’un ai a yw interniaid a gwirfoddolwyr yn cael eu diogelu’n ddigonol gan gyfreithiau presennol, ac yn ymestyn y terfynau amser i ddwyn hawliad o aflonyddu, gwahaniaethu neu annhegwch gerbron Tribiwnlys Cyflogaeth.
 
Ceir yr ymgynghoriad fan’ma
                                                                                                                     
Y terfyn amser ar gyfer ymateb i’r ymgynghoriad yw 2 Hydref 2019.
 
Rhennir yr ymgynghoriad yn ddwy ran:

  • set o gwestiynau ar-lein sydd yn gyflym a hawdd i unrhyw un ymateb iddynt, a 
  • dogfen fwy technegol sy’n gwahodd barnau ar fanylion y gyfraith.  

Mae’r ddau yn bwrw golwg ar yr un materion gyda lefel gwahanol o fanylder.

Government Consultation on Sexual Harassment in the Workplace

The Government Equalities Office have launched the consultation on sexual harassment in the workplace on the 15 July. They are consulting on the mandatory duty, clarifying the law on third party harassment, whether interns and volunteers are adequately protected by current laws and extending the time limits to take a harassment, discrimination or victimization claim to and Employment Tribunal.

The deadline for responding to the consultation is 2 October 2019.
 
The consultation is split into two parts: 

  • a set of online questions that are quick and easy for anyone to respond to, and 
  • a more technical document that invites views on the details of the law. 

Both look at the same issues with a different level of detail.

The EHRC will be submitting a response and making it clear to government that there needs to be a mandatory enforceable duty on employers to take reasonable steps to protect their staff from harassment and victimisation.
