Wales Consultation on Public Procurement Secondary Legislation: Part 1
I have today launched the first of two six-week public consultations on the Secondary Legislation in relation to the Procurement Bill (the “Bill”).
This technical consultation is an important opportunity for businesses and stakeholders to comment on the detail of the secondary legislation. It is not the purpose of this consultation to re-examine the policy intent behind the Bill, rather the consultation questions seek to determine whether the technical detail of the drafting is correct and / or achievable.
The Welsh Government and the UK Government have worked closely on the development of our respective statutory instruments to ensure there is maximum alignment between the legislation and to minimise any risk of potential divergence. For the purpose of this consultation, the draft statutory instrument that has been developed by the UK Government will be used. The consultation supporting document will clearly explain where clauses in the UK Government statutory instrument will not apply. However, the Welsh Government’s draft statutory instrument will mirror (as much as possible) the provisions contained within the UK Government’s statutory instrument, other than in the few areas where there are derogations or Wales-specific differences.

Ymgynghoriad Cymru ar Gaffael Cyhoeddus Is-ddeddfwriaeth: Rhan 1
Heddiw, rwyf wedi lansio’r cyntaf o ddau ymgynghoriad cyhoeddus chwe wythnos ar yr Is-ddeddfwriaeth mewn perthynas â’r Bil Caffael (y “Bil”).
Mae’r ymgynghoriad technegol hwn yn gyfle pwysig i fusnesau a rhanddeiliaid roi sylwadau ar fanylion yr is-ddeddfwriaeth. Nid pwrpas yr ymgynghoriad hwn yw ailedrych ar fwriad y polisi y tu ôl i’r Bil, yn hytrach mae cwestiynau’r ymgynghoriad yn ceisio pennu a yw manylion technegol y drafftio yn gywir a/neu’n gyraeddadwy.
Mae Llywodraeth Cymru a Llywodraeth y DU wedi gweithio’n agos ar ddatblygu ein hofferynnau statudol priodol i sicrhau bod y ddeddfwriaeth mor gyson â phosibl ac i leihau unrhyw risg o wahaniaethau posibl. At ddibenion yr ymgynghoriad hwn, bydd yr offeryn statudol drafft sydd wedi’i ddatblygu gan Lywodraeth y DU yn cael ei ddefnyddio. Bydd dogfen ategol yr ymgynghoriad yn esbonio’n glir lle na fydd cymalau sydd yn offeryn statudol Llywodraeth y DU yn berthnasol. Fodd bynnag, bydd offeryn statudol drafft Llywodraeth Cymru yn adlewyrchu (cymaint â phosibl) y darpariaethau sydd wedi’u cynnwys yn offeryn statudol Llywodraeth y DU, ac eithrio yn yr ychydig feysydd lle mae rhanddirymiadau neu wahaniaethau sy’n benodol i Gymru.
